TERMS AND CONDITIONS FOR THE PURCHASE AND SALE OF GOODS
1. DEFINITIONS
1.1. Seller – The online store https://188eshop.com, operating under individual activity certificate No. 1413259.
1.2. Buyer – 1) a natural person legally capable of entering into contracts, who purchases goods for personal use (non-commercial purposes); 2) a legal entity of the Republic of Lithuania purchasing goods as the end user (intending to use the goods for representational or other non-resale/business/production/service purposes); 3) duly authorized representatives of any of the above-mentioned persons.
1.3. Terms – These terms and conditions define the rights and obligations of the Buyer and the Seller, the terms of purchasing and payment for goods, the procedures for delivery and return of goods, the responsibilities of the parties, and other provisions related to the sale of goods via the online store.
1.4. Party / Parties – The Buyer and the Seller, together or individually.
1.5. Goods – All items offered for sale in the online store.
2. GENERAL PROVISIONS
2.1. These Terms are a binding legal document outlining the rights, obligations, and liabilities of the Buyer and the Seller in relation to the purchase and sale of goods in the online store.
2.2. To use the online store and purchase goods, the Buyer must agree to these Terms. By confirming their understanding and acceptance of the Terms, the Buyer undertakes to comply with them. If the Buyer does not read, understand, or accept the Terms, they cannot purchase goods in the online store.
2.3. By confirming their understanding and acceptance of the Terms, the Buyer also confirms that they meet the definition of a Buyer.
2.4. The Seller reserves the right to modify the Terms at any time. Amendments take effect once published in the online store. Continued use of the online store after such changes constitutes agreement to the updated Terms.
3. CONCLUSION OF THE PURCHASE–SALE CONTRACT
3.1. The purchase–sale agreement is concluded between the Seller and the Buyer. The contract is deemed concluded when:
i) The Buyer submits an order by forming a shopping cart according to the Seller’s instructions;
ii) The Buyer selects a delivery method;
iii) The Buyer selects a payment method and pays for the order.
3.2. The Seller confirms the order by sending an order confirmation and details via email and/or phone. If the Buyer does not agree with all or part of the Terms, they cannot place an order.
3.3. The Seller may send interim notifications before the purchase–sale contract is concluded, such as reminders about pending payments or confirmation of payment received.
4. BUYER’S RIGHTS
4.1. The Buyer has the right to purchase goods from the online store in accordance with the Terms, Seller's instructions, and applicable legal acts of the Republic of Lithuania.
4.2. A consumer-Buyer has the right to withdraw from the purchase–sale agreement within 14 (fourteen) days as per the Terms and Civil Code of the Republic of Lithuania, provided the product is undamaged, unused, and its appearance has not changed substantially.
4.3. The Buyer has the right to return and/or exchange goods and benefit from applicable warranties as stated in the Terms.
4.4. The Buyer also has other rights provided in the Terms and applicable laws.
4.5. The amount paid, including delivery fees, must be refunded within 14 days of the withdrawal notification.
5. BUYER’S OBLIGATIONS
5.1. The Buyer must pay for the ordered goods and delivery, as well as any other charges, including return shipping if applicable.
5.2. The Buyer must accept the goods as per the chosen delivery method.
5.3. The Buyer must inspect the goods upon receipt. If any defects or damage are noted, they must immediately inform the Seller.
5.4. The Buyer must comply with other requirements outlined in these Terms and applicable laws.
6. SELLER’S RIGHTS
6.1. The Seller may suspend or terminate the operation of the online store at any time without notice. Orders placed before the suspension will be fulfilled.
6.2. The Seller has the right to contact the Buyer for clarification regarding the order.
6.3. The Seller may cancel the Buyer's order under the conditions set in the Terms.
6.4. The Seller retains other rights set forth in the Terms and legal acts.
7. SELLER’S OBLIGATIONS
7.1. The Seller must respect the Buyer’s privacy and handle personal data in accordance with the Terms, laws, and Privacy Policy.
7.4. The Seller must deliver the ordered goods according to the chosen delivery method.
7.5. The Seller must accept returned goods in accordance with the Terms and law.
7.6. If the Seller cannot deliver a good, they must refund the Buyer the amount paid within 14 working days.
8. PRICES AND PAYMENT PROCEDURE
8.1. All prices are in euros.
8.2. Goods must be paid for via bank transfer.
8.3. Goods are sold at the prices valid at the time of the order.
8.4. If the Buyer does not agree with the price, they cannot proceed with the order.
8.5. Delivery fees are not included in the product price.
8.6. Order details are sent to the Buyer via email.
9. DELIVERY AND PICK-UP
9.1. Goods are delivered to a DPD parcel terminal.
9.6. Delivery time starts from when the product is collected.
9.7. The Seller is not responsible for late or failed delivery due to third parties or Buyer-related issues.
9.8. If the Buyer accepts the parcel without comment, it is considered undamaged and complete.
9.9. The Seller is not responsible if product appearance differs due to screen settings or personal perception.
9.10. The risk of loss or damage passes to the Buyer upon delivery.
10. RETURN AND EXCHANGE OF GOODS

11. DATA PROTECTION AND PRIVACY POLICY
11.1. The Seller is committed to protecting the Buyer's data and privacy.
11.2. The privacy policy is outlined in a separate section of the store.
12. MARKETING
12.1. The Seller may run promotions and apply discounts at their discretion and may change or cancel them without notice.
12.2. If a discounted item is returned, only the amount actually paid by the Buyer is refunded.
13. LIABILITY
13.1. The Buyer must use the online store lawfully and in accordance with the Terms.
13.2. The Buyer must provide accurate and current information; the Seller is not liable for consequences of incorrect data.
13.3. The Buyer is responsible for the security of their data and may not disclose it to third parties.
13.4. If a third party uses the Buyer's data, they are considered the Buyer.
13.5. The Seller is not liable if the Buyer suffers losses due to not reading or understanding the Terms.
13.6. Only direct losses are compensable.
13.7. The Seller is not liable for non-fulfillment due to third parties or force majeure. If such events last over one month, the agreement may be terminated.
14. FINAL PROVISIONS
14.1. The Terms and purchase–sale agreements are governed by Lithuanian and EU law.
14.2. The Seller may change the Terms unilaterally at any time.
14.3. Information on the Seller’s website is considered written communication.
14.4. The Seller may transfer rights and obligations under these Terms to third parties without the Buyer's consent.
14.5. Disputes are resolved through negotiation. If unsuccessful, they are settled under Lithuanian law.
14.6. The Buyer may use out-of-court procedures for complaints via the State Consumer Rights Protection Authority. Complaints must be submitted within three months of the alleged violation.
